On September 30, 2006, the U.S. Congress passed the SAFE Port Act which also contained certain provisions known as the Unlawful Internet Gambling Enforcement Act of 2006 (the Act that affects the processing of payments between US customers and certain online gaming companies). The legislation was signed into law by President George W. Bush on October 13, 2006. As a result of this Act, some online gaming merchants have chosen not to accept new U. S. players until legality of the Act has been resolved in the courts.
Other online gaming merchants have chosen to continue business as usual. Most U. S. banks have chosen to implement provisions of the Act several months prematurely and are already blocking many payments to and from gaming sites. Only a handful of U. S. states have passed laws making online gaming illegal. Most states making gaming illegal have been pushed by their own land based casino industries.
The World Trade Organization has ruled that the U. S. acted illegally in passing the Act allowing countries injured by it to impose trade sanctions against the United States. So far only some small Caribbean Island nations have pursued sanctions. However, the European Union has indicated they will also pursue sanctions against the United States. The potential cost to the United States could reach billions of dollars a day and further aggravate trade deficits.
